Environmental

Knowledge

Clients of MMOT benefit from the diverse and extensive work experience, common sense, and technical backgrounds of our attorneys. Our environmental lawyers have extensive experience advising clients in a wide range of industries, including petrochemical manufacturing, petroleum refining, commercial waste management, utilities and Brownfields development, among others. Our attorneys' technical backgrounds include chemical engineering, environmental science, geology and hydrogeology.

Experience

The environmental legal expertise of our attorneys includes substantial experience in areas such as regulatory compliance, enforcement, permitting, rulemaking, legislative and regulatory lobbying, administrative hearings, Superfund, and environmental litigation (including litigation involving CERCLA, RCRA, CAA, FIFRA, TSCA, and TSWDA). It also includes representing business, real estate and financial clients in transactional matters, such as due diligence, negotiating environmental representations and warranties and indemnities in the acquisition or sale of real property and in utilizing protections available under federal and state “Brownfields” legislation. One of our lawyers was instrumental in drafting the Texas Clean Air Act, and another in the drafting of the Texas Risk Reduction Program, the Spill Reporting Rules and the Underground Storage Tank rules at the Texas Commission on Environmental Quality. Several of our lawyers assisted in litigating one of the longest and most complicated contested permitting hearings involving the Texas Commission on Environmental Quality ever heard by the State Office of Administrative Hearings.
